Terms of Service

These Terms of Service explain the conditions that apply when you access the AtlantisFX website, request information, use AtlantisFX client-facing tools, purchase services, or work with AtlantisFX Oy on AI visibility, SEO infrastructure, website analysis, automation, reporting, and digital growth projects.

Overview

These Terms of Service are a legal agreement between you and AtlantisFX Oy, referred to in these Terms as “AtlantisFX”, “we”, “us”, or “our”. They apply to the AtlantisFX website, service pages, client portal features, communication channels, proposals, reports, digital workflows, and any services supplied by AtlantisFX unless a separate written agreement states otherwise.

AtlantisFX provides professional digital visibility, AI visibility, search engine optimization, website analysis, automation, client workflow, reporting, and web infrastructure services. Our services are designed to support business growth, operational clarity, and digital presence. They do not replace legal, tax, accounting, medical, financial, investment, cybersecurity certification, or regulated professional advice.

If a signed contract, written proposal, order confirmation, subscription agreement, or custom statement of work is agreed between you and AtlantisFX, that document may contain additional or more specific terms. If there is a direct conflict between these general Terms and a signed written agreement, the signed written agreement will normally control for that specific project, unless mandatory law requires otherwise.

Important: By using the AtlantisFX website, requesting services, creating an account, accessing the client portal, approving a proposal, or purchasing a service, you confirm that you have read, understood, and agree to these Terms.

AtlantisFX is operated by AtlantisFX Oy. AtlantisFX provides digital services for businesses, professionals, organizations, and website owners who want to improve their online visibility, technical structure, AI search readiness, SEO foundation, automation capability, and digital customer journey.

Acceptance of These Terms

You accept these Terms when you use the AtlantisFX website, submit a form, request an analysis, communicate with AtlantisFX about services, access the client portal, approve a service plan, pay an invoice, complete a checkout, or otherwise engage AtlantisFX to perform work.

If you are acting for a company, organization, or other legal entity, you confirm that you have authority to bind that entity to these Terms. If you do not have such authority, you must not approve services, create an account, or submit company data on behalf of that entity.

You must not use AtlantisFX services if doing so would violate applicable law, contractual obligations, third-party rights, platform rules, payment provider requirements, data protection obligations, or any restrictions applicable to your business, location, industry, or website.

AtlantisFX Services

AtlantisFX services may include, depending on the selected plan, proposal, or project scope:

AI Visibility

Analysis and recommendations for improving how a business may appear across AI-assisted discovery systems, answer engines, search journeys, and machine-readable brand signals.

SEO Infrastructure

Technical SEO review, content structure guidance, internal linking recommendations, indexing readiness, metadata review, and website architecture improvements.

Website Analysis

Review of website structure, user journey, conversion flow, trust signals, technical issues, performance indicators, and practical improvement priorities.

Automation

Planning or implementation of digital workflows, AI-assisted reporting, lead handling, content operations, customer communication, and business process automation.

Client Portal

Access to project status, messages, reports, service updates, files, workflow information, plan information, and account-related client tools where available.

Digital Growth Support

Strategic recommendations for local visibility, Google presence, brand trust, content planning, service positioning, analytics, and long-term digital infrastructure.

The exact deliverables, timing, level of support, number of reports, technical implementation, revisions, communication method, and project boundaries depend on the plan, proposal, written agreement, order confirmation, or service page applicable to the purchase.

AI, SEO, Ranking, and Visibility Limitations

AtlantisFX may use AI-assisted methods, technical analysis, manual review, data interpretation, SEO tools, automation tools, public search information, website scans, client-provided inputs, and third-party platform signals to support recommendations. These tools help with analysis, but they do not create guaranteed outcomes.

You understand and agree that AtlantisFX does not guarantee:

  • first-page Google rankings;
  • specific organic traffic increases;
  • specific AI search visibility;
  • appearance in ChatGPT, Google AI Overviews, Perplexity, Gemini, Copilot, or other AI systems;
  • Google Business Profile rankings or map pack placement;
  • indexing speed or search engine crawling behavior;
  • sales, leads, revenue, conversions, or market share;
  • approval by any third-party platform, payment provider, search engine, or AI system.

Search engines, AI platforms, social platforms, payment providers, hosting providers, plugins, APIs, advertising platforms, analytics tools, and browser technologies may change their rules, algorithms, policies, availability, or ranking systems at any time. AtlantisFX is not responsible for changes made by third parties.

No ranking guarantee: AtlantisFX provides professional analysis, implementation support, and strategic recommendations. Search and AI visibility depend on many factors outside AtlantisFX control, including competition, platform rules, website history, content quality, technical limitations, market demand, user behavior, and third-party algorithms.

Client Responsibilities

You are responsible for providing accurate, complete, current, and lawful information needed for AtlantisFX to deliver services. This may include website access, company information, business descriptions, service details, target markets, analytics context, branding materials, technical details, legal requirements, and project preferences.

You confirm that:

  • you have the right to submit any content, documents, images, data, logos, account information, or materials you provide;
  • your business, website, services, and submitted materials do not violate applicable law or third-party rights;
  • you will not submit unlawful, misleading, infringing, harmful, abusive, defamatory, discriminatory, or malicious content;
  • you will review all recommendations, reports, website changes, AI-assisted outputs, and deliverables before relying on them;
  • you will maintain secure access to your own accounts, websites, hosting, domains, email, analytics tools, and third-party platforms;
  • you will promptly provide information, approvals, corrections, and access reasonably needed for the project.

You must not send passwords, secret API keys, payment credentials, database credentials, private keys, or other sensitive access details through insecure channels. If access is required, AtlantisFX may ask you to use a secure method or a limited-access account. AtlantisFX may refuse to process access details that are provided in an unsafe manner.

Delays caused by missing information, late approvals, unavailable access, third-party restrictions, unclear instructions, unpaid invoices, or client-side technical limitations may extend delivery timelines and may not entitle you to a refund unless required by law or separately agreed in writing.

Orders, Proposals, Scope, and Changes

AtlantisFX services may be ordered through the website, a pricing page, a written proposal, a custom invoice, manual confirmation, email approval, client portal workflow, or another agreed method. The confirmed plan, proposal, invoice, service description, or written order will define the applicable scope.

Unless otherwise agreed in writing, a service order includes only the deliverables expressly described for that plan or project. Extra pages, extra integrations, additional automation logic, custom development, advanced design revisions, emergency support, migration, third-party tool setup, copywriting, multilingual content, legal policy drafting, payment provider troubleshooting, or platform appeals may require a separate quote or additional fee.

Change requests may affect timing, cost, technical feasibility, and delivery priority. AtlantisFX may decline or separately price work that is outside the agreed scope, legally risky, technically unsafe, harmful to website stability, inconsistent with platform rules, or unsuitable for the client’s website or market.

AtlantisFX may use project management notes, checklists, staged delivery, mockups, reports, client portal updates, screenshots, test environments, draft pages, or written summaries to clarify the project status and required next steps.

Pricing, Payments, Taxes, and Billing

Prices may be displayed on the AtlantisFX website, included in a written proposal, shown in a checkout, stated in an invoice, or agreed separately in writing. Prices may vary by service scope, plan level, technical complexity, market, urgency, custom requirements, and third-party costs.

Unless otherwise stated, prices may exclude applicable taxes, VAT, payment processor charges, third-party subscription fees, domain fees, hosting fees, premium plugin fees, advertising spend, API usage charges, external tool costs, legal review fees, or other third-party costs.

AtlantisFX may use third-party payment processors, bank transfer, manual invoicing, or other payment methods made available by AtlantisFX. Card or payment details may be processed by a third-party payment provider. AtlantisFX does not need to store full card details to process payments through such providers.

You agree to pay all fees when due. AtlantisFX may pause, delay, restrict, or suspend services, portal access, deliverables, revisions, implementation, or support if payment is late, fails, is disputed, is reversed, or is otherwise not received according to the applicable order terms.

Subscriptions, recurring plans, retainers, or ongoing services may renew according to the plan, checkout, invoice, or written agreement. You are responsible for cancelling or changing recurring services according to the applicable cancellation process and the Refund & Cancellation Policy.

Refunds, Cancellations, and Digital Service Work

Refunds and cancellations are handled according to the specific service purchased, the stage of work, the payment method, applicable consumer law, the written order, and the AtlantisFX Refund & Cancellation Policy.

Many AtlantisFX services involve digital analysis, planning, technical work, custom recommendations, AI-assisted review, SEO assessment, website-specific implementation, or business-specific reporting. Once work has started, value may already have been created even if the final project has not yet been fully completed.

Unless mandatory law provides otherwise, AtlantisFX may refuse full refunds for work that has already been started, delivered, customized, downloaded, reviewed, implemented, reserved, scheduled, or consumed. Partial refunds, credits, pauses, or service adjustments may be considered case by case, but are not guaranteed unless required by law or agreed in writing.

Consumer customers may have statutory rights that cannot be excluded by these Terms. If you are purchasing as a consumer rather than as a business or professional client, you should carefully review cancellation rights before ordering digital services or requesting immediate performance.

Client Portal, Accounts, and Access

AtlantisFX may provide a client portal or account-based features for project status, service management, reports, messages, files, payment status, subscription status, workflow notes, or related client communication.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify AtlantisFX if you suspect unauthorized access, incorrect information, account misuse, or a security issue.

AtlantisFX may suspend, restrict, or close account access if we reasonably believe that an account is being misused, used unlawfully, used to access unauthorized information, connected to unpaid services, affected by security risk, or otherwise harmful to AtlantisFX, clients, third parties, or the website.

Client portal features may change over time. AtlantisFX may add, remove, test, improve, or modify portal features, reporting views, project workflows, payment status indicators, message tools, or file areas without creating a guarantee that any particular feature will remain permanently available.

Data, Privacy, AI Processing, and Security

AtlantisFX may process information submitted through the website, forms, email, client portal, project communication, reports, files, website scans, analytics context, business descriptions, or other service workflows. Processing is explained in more detail in the Privacy Policy and the AI & Data Processing Policy.

You are responsible for ensuring that any personal data, business data, client data, website data, documents, screenshots, analytics exports, customer information, or other materials you submit to AtlantisFX are lawful to share and are reasonably necessary for the requested service.

You must not submit sensitive personal data, health data, payment card details, government identity documents, passwords, private keys, secret tokens, children’s data, or other highly sensitive information unless AtlantisFX has specifically requested it through an appropriate secure process and there is a lawful reason to provide it.

AtlantisFX may use AI-assisted tools to support analysis, drafting, summarization, categorization, automation planning, SEO review, and reporting. AI-assisted output may contain errors, omissions, outdated assumptions, or incomplete interpretations. You must review outputs before using them for business, legal, technical, financial, compliance, or publication decisions.

AtlantisFX takes reasonable measures to protect information within the practical limits of the services provided, but no website, transmission, hosting system, plugin, email provider, AI tool, analytics platform, or third-party service can be guaranteed to be completely secure.

Intellectual Property and Use of Deliverables

AtlantisFX and its licensors retain ownership of pre-existing materials, reusable frameworks, internal methods, templates, know-how, workflows, generic code components, design patterns, documentation structures, automation logic, analysis methods, and other materials developed independently of a specific client project.

Unless otherwise agreed in writing and subject to full payment, AtlantisFX grants you a limited, non-exclusive, non-transferable license to use final deliverables created for you for the intended business purpose described in the applicable order, proposal, or project scope.

If a project includes website content, design assets, custom code, plugin configuration, automation workflows, reports, documents, or analysis materials, the exact ownership, usage rights, and source file access may depend on the service package and written agreement. Custom transfer of ownership must be agreed in writing.

You retain ownership of materials you provide to AtlantisFX. You grant AtlantisFX the right to use those materials as needed to perform the requested services, including analysis, editing, technical review, website work, reporting, AI-assisted processing, and project communication.

You must not copy, resell, redistribute, reverse engineer, publish, or commercialize AtlantisFX internal templates, proprietary methods, reports, code, workflows, or materials outside the agreed project purpose without written permission.

Third-Party Tools, Platforms, Plugins, and Services

AtlantisFX services may involve third-party tools, platforms, plugins, APIs, hosting providers, domains, analytics tools, search engines, payment providers, content management systems, WordPress themes, WordPress plugins, AI systems, automation platforms, browser tools, email services, and external software.

Third-party services are governed by their own terms, privacy policies, pricing, availability, technical limitations, and platform rules. AtlantisFX is not responsible for outages, restrictions, pricing changes, account suspensions, policy decisions, API changes, algorithm changes, plugin conflicts, security incidents, or technical failures caused by third parties.

AtlantisFX may recommend third-party tools, but a recommendation does not guarantee that the tool will remain suitable, available, compliant, affordable, secure, or compatible with your website or business in the future.

You are responsible for maintaining your own licenses, subscriptions, renewals, billing, access, data exports, backups, permissions, and compliance obligations for third-party services unless a separate written agreement clearly states otherwise.

Acceptable Use

You agree not to use AtlantisFX services, website forms, client portal, communication channels, automation systems, reports, or deliverables for unlawful, harmful, deceptive, abusive, or unauthorized purposes.

Prohibited use includes, but is not limited to:

  • malware, phishing, spam, credential theft, unauthorized scraping, hacking, or security abuse;
  • misleading advertising, impersonation, counterfeit branding, false company claims, or deceptive offers;
  • infringement of copyrights, trademarks, trade names, privacy rights, publicity rights, or other third-party rights;
  • unlawful processing of personal data or submission of data without appropriate authority;
  • content or services that promote violence, exploitation, discrimination, fraud, illegal activity, or platform abuse;
  • attempts to manipulate search engines, AI systems, payment providers, or user trust in ways that violate applicable rules;
  • any activity that could damage AtlantisFX, clients, service providers, users, or third-party platforms.

AtlantisFX may refuse, suspend, or terminate work that appears unlawful, unsafe, abusive, misleading, reputationally harmful, technically dangerous, or inconsistent with these Terms.

Delivery, Revisions, and Client Review

Delivery timelines are estimates unless a written agreement expressly states that a deadline is strict and binding. Timelines may depend on client input, website access, payment status, technical conditions, third-party availability, platform approvals, plugin compatibility, and scope changes.

If revisions are included, the number and type of revisions are limited to the applicable package, proposal, or written agreement. Revisions must relate to the agreed scope. New requests, changed direction, additional pages, additional integrations, expanded legal text, extra design versions, new automation logic, or major strategy changes may require a new quote.

You are responsible for reviewing deliverables within a reasonable time. If you do not provide feedback, corrections, or rejection within the review period stated in the order or, if no review period is stated, within a reasonable time after delivery, the work may be considered accepted unless mandatory law requires otherwise.

Disclaimers

AtlantisFX provides services with professional care, but the website, client portal, reports, recommendations, technical guidance, AI-assisted outputs, SEO analysis, automation plans, and deliverables are provided on an “as available” and “as applicable to the project scope” basis.

AtlantisFX does not warrant that:

  • the website or portal will always be uninterrupted, error-free, or available;
  • all recommendations will produce a specific commercial result;
  • third-party services will remain available or unchanged;
  • search engines or AI systems will index, rank, cite, display, or recommend your website;
  • automation workflows will be suitable for every future business process without maintenance;
  • AI-assisted outputs will always be complete, accurate, current, or free from error.

You are responsible for deciding whether any recommendation, report, implementation, content, workflow, or technical change is suitable for your business, legal obligations, customers, internal processes, and risk tolerance.

Limitation of Liability

To the maximum extent permitted by applicable law, AtlantisFX will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of business, loss of goodwill, loss of data, loss of search ranking, loss of AI visibility, loss of leads, platform suspension, third-party account action, or business interruption.

To the maximum extent permitted by applicable law, the total aggregate liability of AtlantisFX for claims relating to a service will be limited to the amount you paid to AtlantisFX for the specific service giving rise to the claim during the three months before the event that caused the claim, or the project fee for that specific project, whichever is lower, unless mandatory law requires a different result.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including liability for intentional misconduct, gross negligence, mandatory consumer rights, or other liability that cannot legally be limited.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless AtlantisFX, its owners, directors, employees, contractors, service providers, and partners from claims, damages, losses, liabilities, costs, and expenses arising from:

  • your breach of these Terms;
  • your unlawful or unauthorized use of services;
  • materials, data, content, or instructions you provide;
  • your website, products, services, customer claims, or business operations;
  • infringement of third-party rights caused by your materials or instructions;
  • your violation of law, platform rules, payment rules, or data protection obligations.

Suspension and Termination

AtlantisFX may suspend or terminate services, portal access, account access, project work, or communication if you breach these Terms, fail to pay, provide unlawful or unsafe materials, misuse services, create security risk, violate third-party rights, request prohibited work, or behave abusively toward AtlantisFX or its service providers.

You may terminate services according to the applicable order, subscription terms, cancellation process, written agreement, and Refund & Cancellation Policy. Termination does not automatically cancel amounts already due or work already performed.

After termination, AtlantisFX may retain records as required for accounting, legal, tax, dispute, security, compliance, or legitimate business purposes, subject to the Privacy Policy and applicable law.

Business Clients and Consumer Rights

AtlantisFX services are primarily intended for businesses, entrepreneurs, professionals, website owners, organizations, and commercial clients. However, if you purchase as a consumer, mandatory consumer protection rules may apply and may override parts of these Terms.

Nothing in these Terms is intended to remove rights that cannot be removed under applicable consumer protection law. Where consumer rights apply, information about cancellation, refunds, digital services, and statutory rights should be read together with the Refund & Cancellation Policy.

If you are unsure whether you are buying as a business client or consumer, you should contact AtlantisFX before purchasing.

Governing Law and Dispute Resolution

These Terms and AtlantisFX services are governed by the laws of Finland, unless mandatory consumer protection rules, data protection rules, or other mandatory laws require a different result.

The parties will first try to resolve disputes through good-faith communication. You should contact AtlantisFX with a clear description of the issue, relevant order details, screenshots, dates, payment references, and requested resolution.

If a dispute cannot be resolved informally, disputes may be handled by the competent courts of Finland, unless mandatory law gives a consumer or another party the right to use another forum.

Changes to These Terms

AtlantisFX may update these Terms from time to time to reflect changes in services, legal requirements, payment methods, client portal features, technology, AI tools, third-party platforms, or business operations.

The updated version will be posted on this page with a new “Last updated” date. Continued use of the website, client portal, or services after updated Terms are published means you accept the updated Terms, unless mandatory law requires another form of notice or consent.

For material changes affecting an active paid service, AtlantisFX may provide additional notice where reasonably appropriate.
